Fire Code Board of Appeals

Resolution Procedures
At times when project or site specific conditions make it impractical to comply with the strict letter of the code or there are questions regarding specific requirements, the contractor may request a Consultation, Fire Marshal review or Appeal to the Fire Code Board of Appeals to resolve these issues. The following steps shall be used:

Question(s):
A contractor representative shall contact the plan reviewer or inspector in writing and submit their question(s) specific to the project, plan or installation. If the contractor/installer/designer is dissatisfied with the answer, a consultation may be requested.

Consultation:
Contact the CAFMA Administration Office at (928) 772-7711 to make an appointment to meet with the plan reviewer/inspector. This consultation will be scheduled within 3 business days. The Fire Marshal (when available) may attend with the plan reviewer/inspector to assist in making a determination or to clarify requirements. If resolution cannot be achieved then a Fire Marshal review may be requested.

Fire Marshal Review:
Upon receipt of a written request, the issue under review will be forwarded to the Fire Marshal for additional research and review. If the contractor desires, additional comments, supporting documentation, etc. may be submitted in writing in to the CAFMA Administration Office, prior to the Fire Marshal’s review. The contractor will be notified in writing of the Fire Marshal Review decision. If the contractor requires further mediation, a Fire Code Board of Appeals Review may be requested.

Fire Code Board of Appeals:
If all other methods of remediation have not produced a viable and agreed upon resolution, a Fire Code Board of Appeals Review may be requested. A request for appeal shall be based on a claim that the intent of this code or the rules legally adopted have been incorrectly interpreted, the provisions of the code do not fully apply, or an equivalent method of protection or safety is proposed.

To request review by the Fire Code Board of Appeals, submit the variance request form, either electronically or by delivery to: Central Arizona Fire and Medical Authority, 8603 E. Eastridge Drive, Prescott Valley, AZ 86314, Attn: Fire Code Board of Appeals. The Board shall meet within 10 days after a notice of appeal has been received. The board does not have authority to waive requirements of the fire code.

All decisions shall be written and recorded in the appropriate CAFMA file and forwarded to the requesting contractor.
